Why Your Philadelphia Workers' Compensation Claim Was Denied

Under the Pennsylvania Workers’ Compensation Act, an employer has 21 days after receiving notice of your injury to accept your claim, deny it, or issue a temporary Notice of Compensation Payable. That temporary acceptance allows the employer to pay benefits for up to 90 days while they investigate — and then stop payments at any point during that window if they decide to deny. When a denial comes, it arrives as a Notice of Workers’ Compensation Denial or a Notice Stopping Temporary Compensation. The form lists an official reason, but the real reason is almost always the same: the insurance company is betting you won’t fight back.

Pennsylvania’s Bureau of Workers’ Compensation requires employers to list one of five official grounds for denial on the denial notice. Here is what those grounds actually mean in practice, and how we fight them:

  • The injury is not work-related — The insurer is claiming your injury happened outside the course and scope of your employment. We gather employment records, incident reports, coworker statements, surveillance footage, and medical records to establish exactly where and how your injury occurred.
  • The injury is not disabling — An insurer-hired doctor has said your injury is minor and does not prevent you from working. We challenge IME doctors and connect you with treating physicians who properly document the nature and extent of your condition.
  • You failed to report the injury on time — Pennsylvania gives you 120 days to report a workplace injury to your employer. If the insurer claims you missed this deadline, we examine when you first knew — or should have known — your condition was work-related, which is especially important for repetitive stress injuries and occupational diseases.
  • You are classified as an independent contractor — Many Philadelphia employers misclassify workers to avoid paying workers’ compensation premiums. We challenge improper independent contractor classifications by examining the actual nature of the work relationship under Pennsylvania law.

  • Claim Petition — If your initial claim is denied, we file a Claim Petition with the Pennsylvania Bureau of Workers’ Compensation. This triggers a formal hearing process before a Workers’ Compensation Judge assigned to the Philadelphia district. Both sides present evidence, medical expert testimony, and witness testimony. The judge then issues a decision accepting or denying benefits.
  • Review, Reinstatement, and Penalty Petitions — If benefits have been modified, suspended, or terminated unfairly after an initial acceptance, we file the appropriate petition to restore them. Penalty petitions can also require the insurer to pay fines for unreasonable contest or bad-faith conduct.
  • Workers’ Compensation Appeal Board — If the WC Judge rules against you, we have 20 days to appeal to the Workers’ Compensation Appeal Board, a 12-member panel that reviews the record for legal error. No new evidence is introduced at this level — the record from the judge’s hearings is what matters, which is why building a strong record from the start is critical.
  • Commonwealth Court of Pennsylvania — If the Appeal Board rules against you, we have 30 days to appeal to Commonwealth Court. The court reviews the Board’s decision for errors of law and whether the factual findings are supported by substantial evidence.
  • Pennsylvania Supreme Court — In limited circumstances involving significant legal questions, cases can be appealed to the Pennsylvania Supreme Court. A ruling at this level is final and non-appealable.

What Happens to Your Benefits During a Dispute

If Your Claim Was Never Accepted

Once that notice is filed, your benefits stop and you must file a Claim Petition to get them reinstated. During the petition process, benefits are not automatically reinstated — you are essentially fighting to have them start. If Benefits Were Accepted Then Stopped

If your claim was accepted and benefits are now being terminated or modified through a petition filed by your employer, you have stronger protections. Under Pennsylvania law, once benefits are flowing, the employer bears the burden of proving you are no longer entitled to them. Your benefits should continue during the litigation unless and until a judge rules otherwise. If Medical Care Has Been Cut Off

30 days to appeal an adverse Workers’ Compensation Appeal Board decision to Commonwealth Court, and 30 days to appeal a Commonwealth Court ruling to the Pennsylvania Supreme Court. These appellate deadlines are absolute. The further up the chain the case goes, the more critical it is to have built a complete, well-documented record at the trial level — which is why the decisions made at the Claim Petition stage matter so much.

The three-year statute of limitations runs from the date of injury or the last payment of compensation, whichever is later. If your benefits were paid and then stopped, the clock may have restarted from the last payment date. Do not assume your rights have expired without speaking to us first.
